Karnataka HC Refuses To Quash FIR Against Atul Subhash’s Wife: ‘All Ingredients Made Out…’

The Karnataka High Court on Monday refused to quash the FIR against Atul Subhash’s wife Nikita Singhania, saying all ingredients of the offence of suicide abetment seemed prima facie present in the FIR against her.

Atul Subhash, a software engineer in Bengaluru, died by suicide last month after alleging harassment by his wife and his in-laws. His death sparked a national outcry demanding tougher laws on women and alimony. Nikita Singhania, her mother Nisha Singhania and brother Anurag Singhania were booked for abetment of suicide on the basis of the complaint filed by the deceased’s brother.

While hearing the case, Karnataka HC Justice SR Krishna Kumar said, “My reading of this complaint is that ingredients are made out. And it is not a case of quashing.”

Singhania’s lawyer said the FIR was challenged as it does not disclose the commission of the offence, but the court said that the complaint has all the details regarding the alleged offence.

“Details are given (in the complaint and FIR). Look at the complaint. All details are given. Tell me what more should have been given for abetment of suicide? According to me, all contents of abetment are there. Everything is narrated. In matters of this type, what more do you want?” the HC further said.

The hearing was adjourned after the court asked the prosecution to submit details of the probe conducted so far and the material collected.
